Health Care

The healthcare industry operates in a complex and ever-changing legal and regulatory environment.  As these changes occur, they often have a dramatic, and negative, impact on the bottom line.

We help our healthcare clients manage change.  When Congress enacted legislation in 1997 that drastically altered the Medicare and Medicare reimbursement programs, we were there to guide our clients through the restructurings that enabled them to stay alive, and ultimately to thrive.

Representative Clients & Cases:

  • Mariner Post-Acute Network, Inc. / Mariner Health Group – ST&G represented the debtors in these highly complex and successful chapter 11 cases involving skilled nursing facilities, long term care facilities, institutional pharmacy services, and other business lines.
  • Maxicare, Inc. – ST&G represented the debtor, a California licensed HMO, in this successful chapter 11 case.
  • Nu-Med, Inc. – ST&G represented the debtor in this successful chapter 11 case.
  • Sun Healthcare Group, Inc. – ST&G represented the debtor as special counsel to address certain postconfirmation matters regarding plan implementation.
  • UHP Healthcare – ST&G currently represents the debtor, a California licensed HMO, in its chapter 11 case.  A chapter 11 plan of reorganization was confirmed and creditors were paid in full.
  • Valley Health System – ST&G currently represents the debtor, a California Health Care District, in its chapter 9 case.  At the time the case was filed, the debtor owned and operated 3 acute care hospitals, a skilled nursing facility and provided other health care related services to a community of approximately 100,000 people. During the course of the case, we have successfully: (1) avoided the appointment of a patient ombudsman, generally required under the Bankruptcy Code, (2) resolved complex legal issues with the debtor's unions following a year of litigation, (3) protected the client from efforts by its bondholders to force the debtor to provide "adequate protection", (4) closed the sale of one of the debtor's hospitals, (5) negotiated and documented the sale of the debtor's remaining hospital assets and completed a 6 day plan confirmation trial involving myriad issues pertaining to provisions of the California Government Code, Health and Safety Code and environmental laws.
  • Century City Doctors Hospital – ST&G currently represents the senior secured prepetition lenders and postpetition financiers in this chapter 7 case.
  • Brotman Medical Center – ST&G represented a secured creditor in this chapter 11 case.
